1. Definitions

For the purpose of these Terms and Conditions:

• Business Day: Any calendar day, except Saturdays, Sundays, or public holidays in Spain.

• Consumer: Any natural person not acting in the course of a profession or business who enters into an Agreement with Watches of Ibiza via the website.

• Agreement: Any agreement concerning orders placed for Products available on the Watches of Ibiza webshop concluded between Watches of Ibiza and the Consumer.

• Durable medium: Any instrument, including email, which allows the Consumer to store information for future reference in an unchanged form.

• Watches of Ibiza Webshop: The online shop of Watches of Ibiza on www.watchesofibiza.com

• Products: All watches and accessories sold by Watches of Ibiza.

• Parties: Watches of Ibiza and the Consumer collectively.

2. Applicability
These Terms and Conditions apply to any Agreement for the sale and delivery of Products through the Watches of Ibiza Webshop. By placing an order, the Consumer agrees to be bound by these Terms and Conditions. Additional product-specific terms, if applicable, will be specified in the product offer.

3. Offers and Orders
Product descriptions and prices on the website are for general information. Watches of Ibiza is not bound by typographical errors. All offers are subject to availability. Watches of Ibiza reserves the right to cancel orders for out-of-stock items, with a full refund issued.

4. The Agreement
The Agreement becomes effective upon order confirmation. An automated email will confirm receipt of the order. Watches of Ibiza reserves the right to reject or cancel an order in cases including, but not limited to: product unavailability, suspected fraud, incorrect billing information, resale, price errors, or shipping restrictions.

5. Prices
All prices are in Euros, including Spanish VAT. Shipping costs, import duties, and any other applicable charges are the Consumer’s responsibility.

6. Right of Withdrawal
Consumers may withdraw from the Agreement within 14 calendar days without giving a reason. Certain products, including sealed items that cannot be returned for hygiene reasons, are exempt from returns. To exercise withdrawal, Consumers must notify Watches of Ibiza via email or the website’s Return Merchandise Authorisation. Products must be returned in original condition and packaging. The Consumer bears the risk and cost of return shipping. Refunds will be issued within 14 calendar days after receiving the returned product, excluding shipping costs.

7. Payment
Payments must be completed using the methods available on the website. Watches of Ibiza may change payment methods at any time.

8. Shipping and Delivery
Orders are shipped within 1–3 Business Days after confirmation. Consumers may choose to collect their orders from Watches of Ibiza in Ibiza (address above). Shipping costs and delivery times are indicative. Watches of Ibiza is not liable for delays. Risk transfers to the Consumer upon delivery. Watches of Ibiza retains ownership until full payment is received.

9. Complaints
Consumers must inspect products upon receipt. Complaints must be submitted in writing to info@watchesofibiza.com within 2 months of discovery. Valid complaints may result in repair, replacement, or refund.

10. Liability
Watches of Ibiza is not liable for indirect damages unless caused by intent or gross negligence. Maximum liability is limited to the invoice value of the relevant product.

11. Intellectual Property
All intellectual property rights in the website and products remain the property of Watches of Ibiza. Consumers may not copy or use any content without permission.

12. Privacy
Personal data will be processed in accordance with the privacy policy on the website.

13. Website Availability
Watches of Ibiza does not guarantee uninterrupted access to the website.

14. Miscellaneous
Invalid provisions do not affect the remaining terms. Watches of Ibiza may amend these Terms at any time, with notice on the website. Rights and obligations may be assigned to third parties by Watches of Ibiza.

15. Governing Law and Jurisdiction
These Terms and Conditions and any Agreement are governed by Spanish law. The competent courts in Ibiza, Spain, shall have exclusive jurisdiction for disputes.
